Anti-spam policy

By using Firepush You (You or User) agree to Terms of use (Terms) and this Anti-Spam Policy which is an integral part of the Terms.

1. Basic overview

User may not use Firepush to directly or indirectly send, transmit, handle, distribute or deliver: (a) unsolicited SMS or Web Push messages ("spam" or "spamming"); (b) messages to a phone number or push subscription obtained via harvesting methods or any impermissible electronic collection of address or other information; or (c) messages to recipients who have opted out or to contact records that are incomplete, inaccurate or out of date.

Spam is any SMS or Web Push message you send to someone who has not given you their direct permission to be contacted on the topic of the message.

Firepush reserves the right to supplement, modify, amend or supersede this Anti-Spam Policy, notifying User via the user portal or by posting a revised copy on the Firepush website. User agrees to review the Anti-Spam Policy on a regular basis and remain in compliance at all times.

2. Permission gathering

To send SMS or Web Push messages to anyone using Firepush, you must have clearly obtained their permission. This could be done through:

A. A phone number or Web Push subscribe form on your website.
B. An opt-in checkbox on a form. This checkbox must not be checked by default; the person completing the form must willingly select the checkbox to indicate they want to hear from you.
C. Customers who have purchased from you within the last 12 months or have an ongoing contract with you.
D. If someone completes an offline form (for example, a survey or competition entry), you can only contact them if it was explained to them at the time that you would contact them via SMS or Web Push AND they ticked a box indicating they would like you to do so.

3. Inappropriate recipients

By using Firepush, you agree not to import or send to any phone number or push subscription which:

A. You do not have explicit, provable permission to contact in relation to the topic of the SMS or Web Push message you're sending.
B. You bought, loaned, rented or in any way acquired from a third party, no matter what they claim about quality or permission. You need to obtain permission yourself.
C. You have not contacted in the last 12 months.
D. You scraped or copied from the web.

4. Required content in every message

Every message you send using Firepush must include the following:

A. The name of the sender, together with the current and accurate full legal entity name. If you are sending on behalf of a client, you must include your client's details instead.
B. A clear statement that the recipient may unsubscribe, opt out, or otherwise demand that further messages stop.
C. A method by which the recipient can opt out (for example, replying STOP to an SMS, or tapping the unsubscribe option in a Web Push notification or the source page that registered them).
D. An opt-out mechanism that takes effect immediately. Once a recipient unsubscribes, you must not message them again, other than (where applicable) a single confirmation that the opt-out was successful.
User warrants that it shall comply promptly with all opt-out, unsubscribe, "do not call" and "do not send" requests.

Recipients whose phone numbers or push subscriptions fail repeatedly will be unsubscribed from your list automatically.

5. Verification procedures

Firepush has various layers of approval and monitoring to ensure you comply with this Anti-Spam Policy:

A. We monitor delivery, complaint and unsubscribe rates across your campaigns. Higher than usual complaint, opt-out or failed-delivery rates may result in a warning, and repeated occurrences may result in your account being suspended or terminated and any special bonuses, discounts or features being removed.
B. Our team may verify selected large subscriber lists imported into the system.
C. We monitor industry abuse signals and our own abuse mailbox continuously and can quickly identify accounts causing delivery problems or attracting complaints.
D. If we find that your subscriber list contains records that look like spam traps or harvested data, you'll be asked to clean your list within a given time. If you do not, your account may be suspended or terminated. Firepush will assist with list cleaning where reasonable.
If we discover that you are messaging people without their permission, or using systematically inaccurate or harvested contact data, we may terminate your account with Firepush immediately.
