Getting consent to send marketing messages

Before you can send SMS marketing messages, you must collect proper consent from your customers. This is required by TCPA law.

How Shopify handles SMS consent

Shopify has a built-in SMS marketing consent option in your checkout settings. When enabled, customers see a checkbox at checkout where they can opt in to receive SMS marketing from your store.

To enable it:

  1. Go to your Shopify Admin > Settings > Checkout
  2. Under the Marketing consent section, enable SMS marketing
  3. The consent checkbox will appear at checkout for customers who enter a phone number

Consent language requirements

The consent text shown to customers must include:

  • Your store name clearly identified
  • That they agree to receive promotional SMS messages
  • Message frequency disclosure (e.g. "Message frequency varies")
  • Message and data rates may apply
  • Opt-out instructions — reply STOP to unsubscribe
  • Links to your Privacy Policy and Terms of Service

Key rules

  • The checkbox must be unchecked by default — customers must actively opt in
  • Consent must be freely given and not a condition of purchase
  • Having a phone number alone is not consent — the customer must explicitly agree to receive marketing messages
